Koan Float Technologies has been committed to guarantee our own guarantee
in all possible logical ways.
Our floatsystem requires adequate handling and maintenace however.
When indications are neglected, problems may arise that we will not
take the consequences of.
We trust that in our transactions you'll be satisfied with our conditions
and indications, after all a guarantee is just a 'reality check' and
not an open cheque.
Warranty
39. Koan Float Technologies B.V. warrants that the Products delivered by it
are sound, in the sense that it warrants that on the date that these Products
were actually delivered to the Buyer, they met the specifications of normal
commercial quality and any special specifications stated in the agreement,
if and in so far as these are agreed with the Buyer.
40. Koan Float Technologies B.V. issues a five (5) year warranty for defects
in the polyester and a warranty of one (1) year for defects in any other
components of the Product.
41. The warranty referred to in Article 40 includes defects which appear
under normal business conditions and in the event of proper use of the
Product. The warranty does not cover normal wear and tear as a result of
using the Product, defects as a result of inadequate maintenance or
unskilled use by the Buyer, repairs performed by or on the instructions
of the Buyer, unless an emergency situation can be proven which entailed
that it was impossible to wait for repair by Koan Float Technologies B.V.
42. In order to be able to invoke the warranty, the Buyer must:
a. immediately inform Koan Float Technologies B.V. in writing of the
defect(s) which has (have) been detected and the nature of the defect(s);
b. grant Koan Float Technologies B.V. full cooperation in enabling
Koan Float Technologies B.V. to repair the defect(s) within a
reasonable period.
43. Koan Float Technologies B.V. shall redress any defects falling
under the warranty stated in Article 40 or else the defective
Product(s) or the component(s) of same shall be replaced, whether
or not in the Buyer's company or by delivery of the replacement
component(s), all this always at the discretion of Koan Float
Technologies B.V. Any costs directly connected with the warranty
obligation of Koan Float Technologies B.V. shall be for the
account of Koan Float Technologies B.V., unless it concerns costs
which do not fall under the warranty obligation such as inter
alia - but not exclusively - transportation costs, travelling
and accommodation expenses, wage costs which arise due to acts
of the Buyer and any other costs which cannot reasonably be for
the account of Koan Float Technologies B.V.
